Terms & Conditions
1. Introduction
These Terms & Conditions govern the use of the Dzili owned and operated by One Nine Two For Telecommunication and Internet Devices , By accessing or using the Marketplace, merchants and customers agree to be bound by these Terms.
The Marketplace serves only as a technology platform to connect Merchants with Customers. The Marketplace Owner is not a party to any transaction between Merchants and Customers and disclaims all liability arising from such transactions.
2. Role of the Marketplace Owner
- The Marketplace Owner provides only a digital platform for listing, discovery, and purchase of goods and services.
- The Marketplace Owner does not manufacture, supply, store, sell, or guarantee any goods or services listed on the platform.
- All contracts, rights, and obligations are solely between the Merchant and the Customer.
3. Responsibilities of Merchants
- Merchants must provide accurate descriptions, prices, and terms for their goods or services.
- Merchants are solely responsible for order fulfillment, quality, warranties, returns, refunds, and compliance with applicable laws.
- Merchants agree to indemnify and hold harmless the Marketplace Owner against any claims, disputes, or liabilities arising from their products or conduct.
4. Responsibilities of Customers
- Customers acknowledge that they are purchasing directly from the Merchant, not the Marketplace Owner.
- Customers must verify product details, warranties, and return policies before making a purchase.
- Any dispute regarding delivery, quality, refunds, or product authenticity must be resolved directly with the Merchant.
5. Payments, Fraud, and Chargebacks
- Payments may be processed via third-party payment providers. The Marketplace Owner does not store or control payment details.
- The Marketplace Owner is not liable for fraudulent transactions, unauthorized use of payment methods, or chargebacks initiated by Customers.
- In the event of a chargeback, the Merchant bears full responsibility for contesting, resolving, and absorbing any associated losses or fees.
- Customers acknowledge that initiating fraudulent chargebacks may result in suspension, legal action, or reporting to payment providers and law enforcement.
6. Limitation of Liability
To the fullest extent permitted by law:
- The Marketplace Owner disclaims any and all warranties, express or implied, regarding the platform, including uninterrupted availability, accuracy, or fitness for a particular purpose.
- The Marketplace Owner is not liable for any direct, indirect, incidental, or consequential damages arising out of the use of the platform, including but not limited to loss of profits, goods, data, or business opportunities.
- The Marketplace Owner bears no liability for disputes, product defects, delivery issues, fraud, or chargebacks between Merchants and Customers.
7. Indemnification
Merchants and Customers agree to indemnify, defend, and hold harmless the Marketplace Owner, its officers, employees, and affiliates from any claims, damages, liabilities, legal costs, or expenses arising from:
- The listing, sale, or purchase of goods or services on the Marketplace;
- Misuse of the Marketplace;
- Breach of these Terms;
- Fraudulent or unlawful activities.
8. Dispute Resolution
- Disputes between Merchants and Customers must be resolved directly between them.
- The Marketplace Owner may, at its sole discretion, provide limited support but is under no obligation to intervene or mediate.
9. Termination of Accounts
- The Marketplace Owner may suspend or terminate Merchant or Customer accounts at any time for violations of these Terms, fraudulent activity, or suspected abuse.
10. Governing Law & Jurisdiction
These Terms shall be governed by and construed under the laws of Jordan. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Amman Center.
